Anthropic and OpenAI are already free to “pace the frontier” and should do so for business reasons, instead of first demanding a preferred regulatory framework

Dario has written that we need to “pace the frontier,

@davidsacks David Sacks

Context & Ripple Effects

Anthropic and OpenAI had already publicly supported the “Pacing the Frontier” initiative, while Anthropic separately committed to permanent third-party evaluator access for checking its safety measures. The two moves put voluntary restraint and verifiable safeguards alongside calls for formal AI policy.

Sacks's critique extends his 2025 allegation that Anthropic was pursuing a regulatory-capture strategy: the dispute is over whether frontier labs should make operational commitments first or seek rules that shape the competitive field.

First-order effects

  • Sacks places the immediate burden on Anthropic and OpenAI to show that their stated support for pacing development translates into business-led limits, rather than being contingent on a preferred regulatory regime.
  • Anthropic's evaluator-access commitment becomes a concrete benchmark in the debate, while OpenAI faces pressure to demonstrate comparable operational evidence for its safety position.

Second-order effects

  • A bilateral agreement between the two leading labs to slow development would invite competition-law scrutiny; one public reaction specifically raised Section 1 of the Sherman Act in response to that framing.
  • Third-party evaluation gains importance as a way for Anthropic and OpenAI to distinguish independently checkable safety practices from policy advocacy, affecting how their claims are assessed by policymakers and competitors.

Third-order effects

  • If voluntary pacing is paired with durable independent access, frontier-AI governance may increasingly turn on auditable lab commitments rather than broad statements of intent.
  • The 2023 Frontier Model Forum and the present dispute point to an industry still trying to establish shared safety norms while avoiding arrangements that can be cast as coordination among direct competitors.

The trend: Frontier-AI governance is shifting toward a contest over whether safety restraint should be demonstrated through auditable voluntary practices or secured through government-backed rules.

    Step 1: look up the Kingsbury Commitment of 1913. Step 2: ponder the government-backed telephone monopoly that followed. Step 3: ask yourself which sector features more innovation and competition—landline telephones from 1913-1982 or wireless from 1993-present.

    Seems like there's a pretty clear way to neutralize allegations of regulatory capture: AI firms can agree to zero lobbying and any group they fund—including astroturf safety orgs— having no say in regulation. And they only be consulted by Congress for technical questions.
