Trump signs an EO seeking to pause the TikTok ban for 75 days, in a bid to give him time to negotiate a resolution and protect TikTok's providers from liability

President Trump signed an executive order on Monday seeking to hit pause on a law banning TikTok and to provide a liability shield …

Bottomline: if you're Oracle or Akamai, you're not feeling great tonight.  This is extremely weak sauce in terms of a liability shield.  Apple and Google's lawyers should feel good about their decision to boot TikTok off the app stores.  [embedded post]
  • @matholemeu @matholemeu on bluesky
Still blocked in the App Store.  Tim Apple isn't stupid.

Still can't download TikTok off the Apple or Google app stores.  If that continues, we have our answer as to how much they want to risk legal liability based on Trump's word.  —  @mattschett.bsky.social : Companies that reinstated TikTok already grew their “legal exposure from $0…

And just to be clear, at the core of the Article II duty to take care that the laws be faithfully executed-a duty the guy swore this very day to fulfill-is a prohibition on the executive suspension of statutes.  Remarkably, the order does not even pretend to respect the Act's cri…

Apple and Google would be absolute idiots to trust Trump on this.  Whatever his EO says, they would be in violation of a duly enacted law if they continue to carry TikTok...which means that they would be under a sword of Damocles and Trump would have leverage over them for anythi…

EO says the 75-day freeze - exactly half of the 60 to 90 days we were first to report: wapo.st/3E22Cu2 - will allow government to “pursue a resolution” but notably doesn't mention sale.  —  Meanwhile, in the Oval Office, Trump calls for U.S. to get half.  “If it doesn't get appro…

If you were Apple or Google's general counsel, would you trust a letter from the DOJ based on an order that literally says “this is not a promise”?  We're about to find out
  • @reckless Nilay Patel on bluesky
Trump's TikTok executive order is out - it directs the DOJ to promise app stores and services providers that it won't enforce the law for 75 more days.  And in true incoherent Trump fashion, it then also says the EO is not an enforceable promise here in 3(c).  Perfect. www.thever…

Trump's TikTok EO:  —  “Those actions do not stop the law from being in effect.  And it does not stop, let's say, Oracle, from violating the law — which, as far as I can tell, it is doing right now” says @alanrozenshtein.com  —  www.npr.org/2025/01/20/n...
  • @bobbyallyn Bobby Allyn on bluesky
Trump seeks a 75-day ban pause.  Which is not provided by the law, which allows for 90-day halting of the law if a forced sale is in motion and if president makes certifications to Congress that TT won't be owned by BD.  —  In other words, it remains illegal under federal law to …
  • @pwnallthethings @pwnallthethings on bluesky
sfaict this one doesn't even bother with a pretence of statutory cover for it.  It's just “I won't enforce it for 75 days”.  Going to be some interesting conversations in the GC's offices at Apple and Google for sure
  • @mjsdc Mark Joseph Stern on bluesky
TikTok, Oracle, Apple, and other companies should remember that the ban has a five-year statute of limitations, and the next administration could bring penalties for violations of the law that occur *today* with Trump's blessing.
  • @alanrozenshtein.com Alan Rozenshtein on bluesky
(This is obviously nonsense—there's clearly been a violation of the statute—but this might be an important defense for the companies if Trump or a later administration retroactively tries to punish them for this.)
  • @alanrozenshtein.com Alan Rozenshtein on bluesky
Importantly, this E.O. just boils down to a promise of non-enforcement.  It's not the 90 day extension that the statute provides for in certain circumstances, which if Trump had tried to do would have actually immunized the providers for 90 days.
  • @alanrozenshtein.com Alan Rozenshtein on bluesky
Also says that if anyone tries to enforce the law, it would be “an encroachment on the powers of the Executive.”  [image]
  • @alanrozenshtein.com Alan Rozenshtein on bluesky
Unfortunately for the companies, the usual boilerplate that EOs end with is also here, which undermines the promise of a liability shield.  [image]
  • @mattschett Matt Schettenhelm on x
TikTok EO also at war with itself. It tells DOJ not to enforce law, then cuts loophole for DOJ to do just that: “Nothing in this order shall be construed to impair or otherwise affect: (i) the authority granted by law to” the DOJ. Law grants DOJ authority to seek penalties.

🚨 Read @realDonaldTrump exec order protecting @tiktok_us Pushes divestiture/ban by 75-days No penalties can be accurred or assessed before or during the EO covered period Protects hosting, app stores, etc States may not intervene to enforce the act https://www.whitehouse.gov/...

Ok, progress...along the ‘right’ path — I still am curious what he thinks his administration can do — let's just work through the repeal bill eh? that's the process... But yeah I guess national security and all... https://www.whitehouse.gov/...
  • @adamkovac Adam Kovacevich on x
    4. He's going to spend the next 75 days working out a solution. But the congressionally-passed law still applies during that time. The law isn't “waiting” on Trump to decide what happens next. [image]
  • @petereharrell Peter Harrell on x
Trump's TikTok EO is a broad assertion of Presidential power. It doesn't try to invoke the 90 day extension under the law; it simply asserts that in light of POTUS's national security powers, he can direct a 75 day suspension of enforcement of the law. https://www.whitehouse.gov/…

Trump's executive order on TikTok is out— interestingly asks his AG to not enforce for 75 days not 90 https://www.whitehouse.gov/... [image]
  • @mattschett Matt Schettenhelm on x
Trump's TikTok EO appears to tell his AG to write a letter to service providers that is untrue on its face: “I further order the Attorney General to issue a letter to each provider stating that there has been no violation of the statute”

47's EO on TikTok. I've not read every EO ever, but I'm not familiar with another that tells the government to not enforce a law. I'm curious how this is going to go. https://www.whitehouse.gov/... [image]
  • @adamkovac Adam Kovacevich on x
    2. He limited his order to nonprosecution - but only for 75 days. That's very little time. And as @mattschett notes, the letter will be false on its face. https://x.com/... [image]
  • @adamkovac Adam Kovacevich on x
What stood out from Trump's TikTok Executive order (🧵): 1. He didn't try to invoke the law's 90 extension provision. A tacit acknowledgment that it was too late, and that ByteDance's lack of effort towards divestiture meant the criteria weren't met. https://www.whitehouse.gov/...
  • @teneikaask_you Teneika Askew on x
If you are wondering why TikTok can't be downloaded its b/c this executive order prevents the distribution, maintenance, or updating of applications operated by ByteDance Ltd., TikTok's China-based parent company. For 75 days. https://www.whitehouse.gov/... [image]
  • @adamkovac Adam Kovacevich on x
    3. He did not *direct* companies to restore access to TikTok. He could be doing this behind the scenes, but as I read this it's just nominally protecting Oracle and Akemai from their current noncompliance (though not really).
  • @benbrodydc Ben Brody on x
If I'm reading this correctly, Trump has directed DOJ to not enforce TikTok law for 75 days so he can assess it, complete with non-enforcement letter and a warning to states/private parties https://www.whitehouse.gov/...

As always, time will tell, but I think there's a real chance this is a turning point for Marvel Snap if they put players first. My hunch is that a lot of problems were caused by this publisher relationship and the awkward split of responsibilities. Man I hope so anyway.
