Tesla is the dominant subject, from the 2016 fatal Autopilot investigation to current FSD scrutiny, while Waymo’s child-strike probe and first-responder complaints, Ford BlueCruise users’ reported confusion, and Zoox’s need for an exemption show that the issue spans competing approaches to automation.

Why it matters

NHTSA is becoming both an enforcement backstop and a market-shaping rule setter: it said the 2026 Tesla Model Y was the first model to pass new ADAS tests, while proposing to eliminate manual-brake-pedal requirements for vehicles designed solely for automated driving. If those parallel roles continue, manufacturers’ ability to scale assisted-driving and robotaxi services will increasingly depend on satisfying a regulator that must balance pathways for purpose-built autonomy against evidence of unsafe behavior in public roads.
