The recent arc

The tension

The core tension is between the CFTC’s claim to a unified federal role over federally regulated event and derivatives markets and competing constraints from state gambling regulators, courts and Congress. Kalshi is the clearest test case, while Polymarket investigations underscore conduct and manipulation concerns; in crypto, the CFTC’s expanding framework also intersects with the SEC’s asset-classification role and with exchange ambitions at Coinbase and Blockchain.com.

Why it matters

If this trajectory holds, the CFTC could become a key gatekeeper for the convergence of prediction markets, crypto trading and traditional derivatives infrastructure, determining which platforms can add leverage, clearing and event contracts under federal supervision. But the Kalshi appellate ruling and legislative push to restrict sports betting on CFTC-regulated venues show that the agency’s authority remains contested, so the eventual market boundary is not settled.
