A federal appeals court grants the Trump administration's request to temporarily pause a lower court ruling that struck down most of President Trump's tariffs

CNBC Kevin Breuninger

Context & Ripple Effects

The stay follows the Court of International Trade’s finding a day earlier that the emergency-powers law did not authorize the administration’s sweeping import tariffs. The appeals court’s action puts that lower-court block on the tariff program on hold while the challenge continues.

It also lands after the administration had already paused tariffs on most countries while retaining a baseline rate and raising China duties, underscoring that the tariff framework was being adjusted through both policy decisions and litigation.

First-order effects

  • The administration can continue enforcing the tariffs covered by the stayed ruling for now, rather than immediately unwinding them under the trade court’s order.
  • Importers facing those duties regain no immediate court-ordered relief; their tariff exposure remains contingent on the appeal’s outcome.

Second-order effects

  • Companies buying imported inputs or finished goods must continue planning around tariff costs and legal uncertainty, complicating near-term sourcing and pricing decisions.
  • The stay preserves the administration’s negotiating leverage with trading partners, while challengers must pursue relief through the appellate process rather than the now-paused judgment.

Third-order effects

  • The dispute tests how far emergency powers can support broad trade policy; a final ruling could narrow or reaffirm the executive branch’s ability to impose economy-wide import measures without new legislation.
  • Repeated shifts between tariff announcements, pauses, and court orders could make legal durability—not only the tariff rate—a central variable in supply-chain planning.

The trend: Trade policy is becoming increasingly shaped by the interaction between expansive executive action and judicial review, leaving businesses to operate through unsettled tariff rules.

Trump's tariffs are back—for now.  A court let him reinstate them while he appeals.  More chaos, higher prices, and no stability.  We need to stop presidents from abusing emergency powers and pass my bill to restore tariff authority to Congress.  —  www.cnbc.com/2025/05/29/b...

As predicted yesterday. Settle in for the long legal road ahead. The interesting question is whether the administration starts introducing 301s, 232s, and even the Section 122 or 338 which would be a signal they think they may not ultimately win when it goes to Supreme Court.

Good. Courts need to realize that their approvals will head to congressional-lows if they keep pulling these stunts. Chief Justice Roberts needs to protect his branch by reigning-in rogue activist judges.

Tariffs are now back on according to the Appeals Court just now. Odds are this is going to the Supreme Court.

Whaddaya know. The Federal Circuit temporarily pauses the Court of International Trade ruling on Trump tariffs. It was reckless of the district court to enter the injunction and I'm glad the Federal Circuit saw that. Made this point on @AmericaNewsroom w/ @DanaPerino and
