Britain's competition regulator said on Wednesday that a new restructured Microsoft-Activision deal could require a fresh merger investigation.

I thought we acquired freedom from this acquisition discourse, guess not! Gonna take months at this rate🤦🏻‍♀ ️ Let MS have ABK & move on. Let's all go back to discussing games. https://www.reuters.com/...

UK's CMA: restructured Microsoft-Activision deal could require new probe https://www.reuters.com/... The @CMAgovUK states procedural facts. I still believe the deal should go through now, just like the @FTC is free to keep pursuing its in-house adjudicative proceeding regardless.

Shockingly, people who think that antitrust enforcement should remain weak also think the strategy of suing big tech companies is bad. https://www.nytimes.com/...

This is a comically one-sided piece. The NYT would serve readers better by asking whether the cases are having a disciplining effect on market players (as the judge says) or whether they prove ⁦@linakhanFTC⁩'s point about need for regulatory reform. https://www.nytimes.com/...

A law enforcement agency bringing frivolous lawsuits that it knows it won't win is nothing more than harassment. We don't approve of malicious prosecution of individual citizens, and we shouldn't allow it against businesses either. https://www.nytimes.com/...

“I completely disagree with this approach...She's trying to change a century's worth of antitrust law overnight, and that's not necessarily wise.” Half a century. And for some reason, people were fine changing it abruptly back then. Funny that. https://www.nytimes.com/...

This is not at all unexpected. Also, yet another loss in court for Lina Khan's FTC. You can read Judge Corley's opinion here: https://storage.courtlistener.com/ ... https://twitter.com/...

Another predictable loss for Khan's FTC. MSFT offered concessions to Khan that most prior FTCs would have taken in a heartbeat. Instead of securing pro-competitive conditions, Khan gets an outright loss. https://twitter.com/...

I spoke to @nytimes about the @FTC's loss today in Microsoft-Activision: “Others wondered if Ms. Khan was wasting the FTC's resources on can't-win cases. 'They've crossed the line to being reckless with the cases they are bringing,' said Ashley Baker...” https://www.nytimes.com/.…

Judge Jacqueline Scott Corley: Let me get this straight. You took all the credibility the FTC had accumulated over more than 100 years and bet it against the consumer welfare standard? Lina Khan: I thought Neo-Brandeisianism was due! https://www.youtube.com/...

The NYT runs a straight propaganda piece on behalf of corporate America, saying that Questions Are Being Raised about Lina Khan's antitrust strategy. Turns out they're being raised by right wing think tanks and tech industry groups. [image]

If Lina Khan's FTC continues to be this willing to take massive L's to test novel or non-existent legal theories in open court, they will ironically end up damaging both their cause and the legitimacy of their institution. Thereby causing more harm to consumers over the long term

Microsoft and Activision don't need a PI decision in a strict sense. The FTC does. All that the 2 companies need is for the TRO to go away without being replaced with a PI. I've explained why the TRO itself can't realistically kill the deal. It only has a few days left either way
