Apple is fighting an OpenAI device that has no established specifications, launch date, or proof of commercial viability. The physical object is missing; the lawsuit is already here.

Apple’s real device was the organization

A device organization does not only produce drawings and components. It accumulates decisions: which constraints matter, which compromises survive, which failure modes recur, and which sequence turns an idea into something that can be made repeatedly. Some of that knowledge can be documented. Much of it resides in the judgment of people who have spent years inside the system.

Tang Tan held responsibility for iPhone and Watch product design before his reported departure from Apple. His value to a new hardware effort was therefore not reducible to a marquee Apple name. He had worked inside the organization that converted product judgment into shipped devices.

That structure contains a reinforcing loop: products create experience; experience improves the organization; the organization produces the next generation of products. The loop works while knowledge keeps accumulating inside the same boundary. When enough experienced people move toward one outside project, it begins reinforcing somewhere else.

A celebrated departure became a production system

The first phase looked biographical. In December 2023, reports said Tan planned to leave Apple in February 2024 and join Jony Ive’s LoveFrom to work on AI hardware. The story could still be understood as a former Apple designer recruiting another former Apple designer, with the usual emphasis on pedigree and personalities.

Each phase appeared to complete the story. First, a departure. Then, a design effort. Then, a company. But each also created the conditions for the next, because an AI device project needs more than a celebrated designer at the top. It needs an organization capable of converting design intent into hardware.

By the time Tan was identified as OpenAI’s chief hardware officer, the object being assembled was no longer a list of famous alumni. It was a product organization built from people whose experience had accumulated inside Apple.

Capital made the organizational boundary porous

That average was reported at roughly seven times Google’s pre-IPO level and about 34 times the average among other pre-IPO peers. It does not establish what Tan, Chang Liu, or any other hardware recruit was offered. It does establish the recruiting environment: OpenAI was using extraordinary compensation to turn scarce expertise into immediate organizational capacity.

The issue is not that Apple suddenly stopped valuing retention. The economics surrounding experienced technical labor changed. The same mobility that allows a new company to acquire capability also makes an incumbent’s accumulated knowledge harder to contain, especially when the entrant is not hiring one specialist but constructing an adjacent institution.

The boundary around Apple’s device expertise was once maintained largely by continuity. As that continuity weakened, contracts, interviews, and legal complaints began doing work that tenure and institutional loyalty had previously done quietly.

The lawsuit moves competition upstream

Apple’s lawsuit alleges that Tan directed Apple employees interviewing with OpenAI to share company secrets. It also alleges that iPhone engineer Chang Liu took company secrets when he left for OpenAI’s nascent hardware division. Neither allegation is a finding of fact.

That distinction matters. Experience necessarily moves with a person; protected information is not supposed to. The lawsuit concerns where one ends and the other begins, a boundary that becomes harder to draw when the desired asset is precisely the recruit’s accumulated ability to make products.

Nor does io’s founding, Tan’s title, or OpenAI’s recruiting establish what a future product will be, when it might arrive, or whether consumers will want it. The absence of an established device is not a gap in this story. It is the structural point. Competition has moved upstream from the finished object to the organizational knowledge required to create one.

A company can lose part of its product advantage before a rival has a product.

Apple now treats the device organization not merely as the group that ships hardware, but as a repository whose accumulated knowledge must be defended. OpenAI treats experienced hardware people as the shortest route from software capability to device-making capacity. The two purposes meet in the interview room long before they meet in the market.

Ternus inherited the reversal, not the feud

It is tempting to reduce the conflict to a strained relationship between Tan and his former boss, John Ternus. That scale is too small. Ternus joined Apple in 2001, was named its next chief executive in April 2026, and immediately faced the challenge of retaining top talent amid historic turnover. Reports in June said he was preparing to reshape Apple’s industrial design team and reassert its influence at the executive level.

Those moves and the lawsuit belong to the same structural response. Apple elevated a long-serving hardware executive while trying to strengthen the design institution around him; outside Apple, former members of that institution were assembling an AI-hardware organization under OpenAI. One side needed continuity. The other needed compressed learning.

The actors matter because they carry the knowledge, but the reversal is not personal. An incumbent device company must treat organizational permeability as risk. An entrant trying to build hardware must treat the same permeability as access. The labor market cannot perform both functions without eventually producing conflict.

The prototype arrived as paperwork

By July 2026, no product announcement was required. The movement of Apple’s design talent had itself become the contested asset: who could use the knowledge accumulated inside Apple’s device organization, and under what legal boundary.

Before a chassis reaches a table, the first contested prototype is an org chart in a legal complaint: Tang Tan at the center, Chang Liu at the door, and Apple alleging that its product memory did not leave empty-handed.
