Motion for preliminary injunction GRANTED. Thoughts to follow, but this does not portend well for Florida. https://twitter.com/... https://twitter.com/...

I will say for as much as the cries of anti conservative bias and Big Tech are a bit boy who cried wolf. The protection companies like Facebook have under the First Amendment are extraordinary. They can shut down the account of the President if they want (they did).

Anyhow, politicians like to make noise about 230 because levying the threat of changing 230 against platforms is an effective way of influencing moderation policies, because actually writing laws that impose moderation policy runs into the hard reality of the First Amendment

Hinkle was obviously not swayed by Florida's attempt to brush off platforms' curation as meaningless and expressionless. He seems to understand that those functions are vital for their products to be usable. https://twitter.com/...

@FrankLuntz Statute is done for unless the 11th Circuit (or SCOTUS) reverses. When a judge finds the law clearly unconstitutional enough to grant a preliminary injunction, it's typically fatal.

LOL. Check out this part in the decision about the theme park carve out: “Despite the obvious constitutional issue posed by the exclusion, the Legislature adopted it, apparently unwilling to subject favored Florida businesses to the statutes' onerous regulatory burdens.”

Florida @GovRonDeSantis' top anti-free speech priority just send down in total flames. But it was a solid attempt to install a social media control regime like Putin's Roskomnadzor to force Trump back onto platforms. Brezhnev would be proud of Ron. https://www.washingtonpost.com…

Victory! A federal court has prevented Florida from enforcing a law that prohibits online services from deplatforming political candidates, ruling that it violates the First Amendment in several respects. https://www.eff.org/...

The judge says Gov. DeSantis' extensive public remarks about how Florida's social media rules were meant to attack the perceived liberal bias of tech companies really torpedoed any chance that it could be permissible under the First Am. https://twitter.com/...

A law that says companies can't ban racist/toxic users unless the company owns a theme park in Florida might be unconstitutional? Color me shocked 😮 https://www.nbcnews.com/...

Political showboating may get you the headlines, but it doesn't often get you a statute that holds up in court, @GovRonDeSantis. https://twitter.com/...

@NoughtFollowers You know, with this one they looked at a brick wall, everyone pointed out the brick wall, and they ran into it headfirst. I am less alarmed by a swift and thorough loss in court than I am about many other things

It really is incredible how the entire Florida state GOP rallied around a law that imposed speech regulations with glaring (and hilarious!) First Amendment issues and proudly passed it as some sort of victory for free speech.
