Italy's antitrust authority orders Meta to suspend contractual terms that bar rival AI chatbots from WhatsApp; Meta calls the decision “fundamentally flawed”

Italy's antitrust authority (AGCM) on Wednesday ordered Meta Platforms (META.O) to suspend contractual terms …

Reuters Elvira Pollina

Context & Ripple Effects

Italy’s action follows a July competition inquiry into the rollout of Meta AI in WhatsApp and a later expansion of scrutiny to the platform’s exclusion of competing chatbot services. The order turns that earlier WhatsApp AI investigation into an immediate test of how far a messaging platform can set access rules for AI providers.

The dispute is specifically about contractual access, rather than a broad finding on AI safety or chatbot quality. It puts Meta’s control of WhatsApp’s distribution layer at the center of the competition case.

First-order effects

  • Meta must suspend the contested WhatsApp terms in Italy, opening the possibility for rival AI chatbot providers to seek access under different conditions.
  • Rival chatbot developers gain a near-term regulatory opening in a major messaging channel, while Meta contests the order as flawed.

Second-order effects

  • Meta may need to separate its own assistant strategy from the rules governing third-party AI services on WhatsApp, rather than using a single exclusionary policy across markets.
  • The order raises the cost for other platform operators of using contract terms to restrict AI rivals, especially where regulators view the platform as a gatekeeper.

Third-order effects

  • If sustained, this points toward competition enforcement focusing on AI distribution inside established consumer platforms—not only on the underlying models or app stores.
  • The practical boundary will depend on whether authorities can require interoperability without undermining platform security and product control; the case does not resolve that balance.

The trend: AI competition policy is increasingly shifting from model capabilities to who controls the user-facing channels through which assistants reach consumers.

Can we talk about how sick it is to have a small startup (@interaction) fight the power against the behemoth that is @Meta and WIN, thus forcing them to keep an open platform. They are innovating on product, but to do so legally as well is top tier. Bullish AF @marvinvonhagen

We're really glad to see this outcome and we welcome the Italian Competition Authority's decision.  We also strongly believe the European Commission will follow once it recognizes the very real risk of serious harm to competition created by Meta's new policy.  Free markets and co…

@marvinvonhagen Appreciate you saying that, but it's so ridiculous you even have to go through this. Meta can't claim to be virtuous on AI while shutting down competition on WhatsApp.

hopefully meta takes this as their opportunity to start building a product people want instead of trying to Big Brother their way into market dominance. we welcome competition, not censorship

I think on principles this doesn't make a lot of sense tbh but this should mean that Google should allow me to use grok or lama on Google searches and ChatGPT should allow people to use Hermes in ChatGPT app?

we won!  🌴 Italy just blocked Meta's plan to ban Meta AI competitors from WhatsApp.  Flew to Rome last week to present our case to the Italian Competition Authority.  Only three companies in the room: @Meta , @Interaction , and @OpenAI .  When I read Meta's defense of “AI is putt…
