Apple has gotten the Apple Watch import ban paused after its first day of being in effect.  There will be a determination on January 12th to see if Apple's workaround will be accepted as no longer violating the patent.  If so the ban will be permanently lifted. …

MORE: The Watch is returning to select stores today, with nationwide availability by Saturday Dec. 30, Apple says. The devices, of course, will continue to have the blood oxygen feature at the center of the dispute with Masimo. The return is potentially temporarily till mid-Jan.

What Apple will probably do over the next two weeks: increase the amount of watch channel inventory stored in the US for distribution to Best Buy, Target etc. in case its software fix isn't approved. That would be to mitigate risk of inventory running out due to import ban.

The Apple Watch ban has just been PAUSED, due to an emergency request to the US court of appeals, via @9to5mac 🙏 Apple can now sell Apple Watch Series 9 and Ultra 2 until at least January 10, 2024 where another extension would need to be granted. [image]

With the U.S. import ban on Series 9 and Watch Ultra 2 temporarily paused, I would expect Apple to stuff the channel as much as possible during the pause in case the ban sticks. But Apple will need to properly resolve the issue in the coming months. https://www.theverge.com/...

While the ban was put on hold, much of Apple's corporate workforce is off this week as is standard at Apple between Christmas week and New Years. I wonder if that will slow its ability to get sales online again quickly.

Working around patents is part science and part art, both skills Apple's legal and technical teams excel at.

In the end, I expect Apple won't pay Masimo a dime and maintain the feature.

Importantly, the postponing of the ban is temporally (through Jan 10th), which means the ruling today is not a final resolution, rather a win for Apple giving the company time to find a technical work around for the oxygen blood sensor.

U.S. Apple Watch ban fairly likely to go away on January 12 (if not sooner): workaround and appeal https://ipfray.com/... Apple has filed an emergency motion & U.S. customs may find on Jan 12 modified Watch doesn't infringe. #Apple #AppleWatch #USITC #patent #patents #Masimo [ima…

Apple Stores in the US spent much of the day yesterday packing up Apple Watch Ultra 2s and Series 9s. The idea was to ship them back to Apple facilities. This process requires removing them from inventory, making them unsellable. This is going to be an operational headache.
