The Senate fails to advance the Clarity Act, dealing a major blow to the crypto industry's push for a comprehensive market structure framework

The Senate on Tuesday voted to block the Clarity Act from advancing, dealing a major blow to the crypto industry's push for a comprehensive market structure framework.

CNBC

Context & Ripple Effects

The bill had cleared the Senate Banking Committee in May with a proposed regulatory split that would make the CFTC the main overseer for most crypto assets while leaving digital securities to the SEC. Its path then narrowed: a planned summer vote became a post-recess September vote amid disputes over rules addressing Trump’s digital-currency dealings.

The failed procedural vote ends that legislative push without resolving the regulator assignment at its center. Public reporting and Senate-side discussion framed the impasse around ethics controls, rather than a lack of industry lobbying; Trump had urged passage alongside executives from Coinbase and Robinhood in August.

First-order effects

  • The Clarity Act’s proposed CFTC-led framework for most digital assets does not advance, leaving the bill’s intended SEC/CFTC division unrealized.
  • Crypto companies seeking a comprehensive federal market-structure statute lose the Senate vehicle that had progressed out of the Banking Committee.

Second-order effects

  • The SEC and CFTC are not given the bill’s planned asset-by-asset allocation, prolonging the policy uncertainty that the legislation was designed to address.
  • Coinbase and Robinhood, whose CEOs joined the August White House push, must continue advocating without a cleared Senate path for the framework they supported.

Third-order effects

  • If ethics disputes continue to block agreement, crypto market-structure policy becomes harder to separate from scrutiny of political actors’ digital-asset interests.
  • The episode reinforces a risk of regulated-liquidity fragmentation: absent a federal classification framework, firms and markets lack the single regulatory structure the bill sought to establish.

The trend: U.S. crypto policy is moving from broad agreement on the need for market rules toward a harder fight over who can credibly set them and under what ethics safeguards.

Crypto will be fine either way. The most important thing is to pass the SAVE America Act.

In a statement about the collapse of the Clarity Act, Sen. Cynthia Lummis (R-Wyo.) says Democrats were “never truly serious” about crypto reform, handed a win to “China and every one of our foreign competitors” and accused Democrats of being “pro-socialism”

The U.S. Senate blocked the Clarity Act on Tuesday, the crypto industry's best shot at federal market-structure rules, after the bill fell short of the 60 votes it needed. Democrats withheld support over ethics language aimed at Trump's crypto holdings. https://unchainedcrypto.co…

Very disappointing result. No bill is perfect, but Clarity has a lot of the crypto consumer protections that Dems have been calling for a long time. I hate Trump's personal corruption too, but we shouldn't have held consumer protections hostage to achieve perfection there.

NEWS: The Senate failed to advance the Clarity Act, a landmark crypto market structure bill. The vote was 49-50, with three Republicans voting against: Sens. Susan Collins (Maine), Josh Hawley (Mo) and Jerry Moran (Kansas). (Tillis voted no with a motion to recommit, procedural)

News: Bipartisan side talks on the Clarity Act just shut down. Staff were discussing final potential changes on ethics controls in the hideaway office of Sen. Thom Tillis (R-N.C.). Staff for Tim Scott (R-S.C.) ended the meeting. Talks are done. Vote is now.

Senators pick one of two choices today: 1. vote yes on the CLARITY Act to promote innovation, protect consumers, put new ethics restrictions on elected officials, and create new law enforcement tools to combat illicit finance, or 2. vote no and let other countries lead in buildin…

Today, I voted no on the Clarity Act, legislation meant to regulate cryptocurrency in America. The ethics provisions in this bill are simply too thin. President Trump, his children, and his Cabinet are making billions of dollars in the crypto space, in part from bilking everyday …

🚨NEW: Several Democrats who have spent months negotiating the Clarity Act, including Gillibrand, Warner, Booker, Warnock, Gallego, Alsobrooks and Cortez Masto, have all voted NO. One industry leader just texted me: “It died.”
  • @senlummis Senator Cynthia Lummis on x
This afternoon, Senate Democrats proved they were never truly serious about protecting consumers and preserving American leadership. I sat at the table with Senate Democrats working in good faith to get this done while they played games. For over a year, they presented demands an…

1/ This one stings. Our team gave everything we had to get the Clarity Act across the finish line. So did most of the industry. This was an opportunity bigger than Ripple or one company - we did this for the industry, for consumers and to cement the US's position as the crypto ca…

The only clarity you need is Bitcoin.
  • @senkevincramer Senator Kevin Cramer on x
Elizabeth Warren and the Democrats blocked the Clarity Act because they'd rather obsess over President Trump's personal finances than establish the necessary guardrails to secure American leadership in digital assets. Even though @POTUS and Senate Republicans have negotiated with…

Some excellent news, the crypto industry spent hundreds of millions of dollars threatening politicians, elected a crypto friendly Congress, and still couldn't pass the CLARITY Act. That bill would have let crypto firms become unregulated banks, and prevented the SEC from regulati…

Plenty of blame to go around. If you are choosing sides, fine. As an unaffiliated voter who supports neither party, I think the Democrats are awful for blocking Clarity. I also think it would have passed easily without Trump launching a meme coin.
  • @muneeb @muneeb on x
So the Clarity Act didn't pass. Plan B is for SEC & CFTC to put a framework forward. The administrative version of market structure can deliver most of the benefits. We'll need to codify it later with Congress. We've taken harder punches. Onwards!
  • @senthomtillis Senator Thom Tillis on x
This is not the end for the Clarity Act. We've made substantial bipartisan progress in large part because of the White House. This procedural motion allows us to continue working towards a positive outcome.
  • @adamkovac Adam Kovacevich on x
When we have the next big crypto meltdown and people say “why didn't Congress put any rules in place??” (which is what Clarity does), this will look even sillier than it does today.
  • @eleanorterrett Eleanor Terrett on x
🚨NEW: I asked @Sen_Alsobrooks (D-MD) whether, after playing a key role in negotiations over both GENIUS and Clarity, she was comfortable letting crypto's market structure bill die by voting no today.

Clarity dead. 50 no votes. Immediately thought og this Bloomberg piece about how crypto supported candidates went 48 for 48 last election (which incl Ds, Rs, incumbents, challengers, shoo-ins, longshots). Personally, I wouldn't piss them off them, but hey, you got to do what you …

Upset with Clarity failing? Blame a Senate Democrat. They are bad faith negotiators. In March, I was on stage with @gillibrandny at a @DigitalChamber panel where she “agreed” with me and claimed she wanted “the United States to be at the forefront of this industry.
