The US FTC and 22 state AGs sue Amazon, alleging it overcharged advertisers by $20B+ since 2019 via hidden surcharges, with costs largely passed on to consumers

The Federal Trade Commission on Monday sued Amazon, alleging the e-commerce giant “secretly and systematically overcharged” …

CNBC Annie Palmer

Context & Ripple Effects

The case formalizes an enforcement path that was flagged in June, when reports said the FTC was weighing an advertiser-deception action involving multiple states. It also adds a pricing-and-auction allegation to the FTC's earlier antitrust case over Amazon's platform power and seller fees.

Amazon disputes the allegations and says the complaint lacks evidence of advertiser harm or consumer price increases. The coordinated federal-state filing nevertheless makes Sponsored Ads pricing a distinct focus of enforcement scrutiny.

First-order effects

  • Amazon must defend its Sponsored Ads pricing and auction practices against a joint FTC and 22-state complaint, while advertisers' alleged overcharges become the central factual dispute.
  • The FTC and participating state attorneys general gain a coordinated vehicle to challenge the ad-pricing practices separately from the earlier platform-monopoly case.

Second-order effects

  • Amazon faces pressure to substantiate how Sponsored Ads prices and surcharges are calculated for advertisers and regulators, given the complaint's focus on alleged hidden charges.
  • The action broadens the regulators' examination of Amazon's marketplace economics from seller-facing fees in the 2023 monopoly lawsuit to advertising transactions with businesses.

Third-order effects

  • If the allegations are sustained, opaque ad-auction pricing may be treated as a consumer-protection and competition issue where advertiser costs are alleged to flow through to retail prices.
  • Repeated FTC-state actions against Amazon point toward overlapping scrutiny of a large retail platform's rules, fees, and advertising monetization rather than a single antitrust theory.

The trend: US platform enforcement is increasingly connecting business-facing pricing practices to claimed consumer harm through coordinated federal and state cases.

For years, Amazon has misrepresented to its business customers how it sets advertising prices — extracting billions from unwitting advertisers and driving up prices. With @FTC and other AGs, we're suing to protect small and medium-sized businesses as well as consumers.

I'm joining the FTC and a bipartisan coalition of AGs in suing Amazon for secretly, systematically, and illegally overcharging businesses that advertise on its platform. Amazon rigs its advertising auctions to force businesses to pay more, inflating their own profits at the

A new lawsuit filed today by the Federal Trade Commission (FTC) and 22 states, including Washington, alleges that Amazon has for years artificially inflated the prices of ads on its e-commerce platform and misrepresented how the company sets ad prices.

The @FTC and 22 states are taking real action against Amazon's alleged advertising auction scheme. Turning a supposed second-price auction into a hidden first-price scheme that cost advertisers tens of billions is exactly the kind of deceptive platform conduct that demands accoun…

Digital markets play a critical role in the American economy—but they only work when participants can trust that powerful tech platforms play by the same rules as everyone else.  That trust is foundational.  Today, the Trump FTC—joined by 22 states—filed suit alleging that Amazon…

Stop following the meek Trump administration. Deception isn't the problem, abuse of market power is. State AGs have a habit of cowering in the face of corporate power. It's changing, but not fast enough. Not as bad as letting the egg cartel off, but not great.

WOW, umm...this is kind of a huge deal. Complete stab in the back to sellers if true. Like holy shit, I didn't think seller sentiment could get any lower but this is taking money directly out of seller pockets.

The pressure is really turning up on Amazon. Tactics to squeeze as much as they can, everywhere they can, won't last forever. I predict a class action civil suit coming at Amazon soon as well.
