In opening arguments, US state AGs say that Meta intentionally sought to addict children to Facebook and Instagram in pursuit of profit; Meta rejects the claims
Meta Platforms (META.O) rejected accusations by U.S. states that it intentionally sought to addict children to its Facebook …
Reuters
Context & Ripple Effects
The case grew out of a 2023 bipartisan suit by 42 attorneys general alleging that Facebook and Instagram used addictive features aimed at young users. It now moves from pleadings into a courtroom test of the states’ evidence and Meta’s defense.
The trial arrives after Meta said that four states were seeking $1.4 trillion in damages in related youth-addiction claims. Separate opening statements in New Mexico earlier this year also focused on alleged misrepresentations about platform safety, extending the legal scrutiny beyond a single venue.
First-order effects
- U.S. state attorneys general must now substantiate their allegations about Meta’s product design and conduct in court, while Meta must defend Facebook and Instagram against claims it says are unfounded.
- The proceeding raises the immediate legal exposure around youth-safety claims that Meta has already said carry exceptionally large damages demands in related state cases.
Second-order effects
- The New Mexico case and the multistate litigation create parallel tests of Meta’s safety representations, making evidence developed in one proceeding consequential to the wider state-led challenge.
- Facebook and Instagram’s youth-focused product decisions face more sustained legal scrutiny as the dispute shifts from allegations in lawsuits to adversarial presentation of evidence.
Third-order effects
- If state-led cases establish liability over alleged addictive design or safety representations, platform governance may increasingly be set through product-liability litigation rather than solely through company policy.
- The litigation pattern points toward more interface-neutral scrutiny of how large platforms design and represent youth-facing services, regardless of whether users access them through Facebook or Instagram.
The trend: State attorneys general are turning youth-safety allegations against major social platforms into courtroom tests of product design, disclosure, and platform governance.

Sitting here in the #socialmedia trial against @Meta listening to Arturo Bejar testify for the third time this year, and for the most part his testimony is following pretty closely what he said in Santa Fe and Nashville.

“Time and time again, @Meta chose profits” over wellbeing of users, Megan O'Neill tells jury, getting into “beauty” filters on @Instagram. Filters were a big part of the KGM trial in LA in February. Looks like the states will also focus on them. #socialmediatrial

.@Meta has built its business around addictive feeds and features that put our kids' mental health at risk. Today, together with a bipartisan coalition of AGs, we begin our trial to hold Meta accountable and to continue protecting our kids from the harms of social media.

California's O'Neill is now getting into #COPPA — new territory in the #socialmediatrials this year. She has to tread a narrow path here with #Section230 in showing content “directed to children.” Not hearing any objection from @Meta though.

Bejar has been such an effective witness for the plaintiffs in the 3 previous trials, I think, because he's both an internal whistleblower hearing stuff within @Meta , but he also comes off as speaking with the authority of an expert witness. Like a pitcher who's also a strong

For years, Meta built features into Facebook and Instagram designed to keep kids hooked, while telling parents their kids were safe. Today a coalition of states, including Idaho, opens trial against Meta for allegedly exploiting children's vulnerabilities and hiding the risks.

Meta trial in the worst possible district for corporate defendants, hence why the stock is being hammered. But the case, while strong enough, might not survive a supreme court review. Contrary view but i didn't go to law school for nothing

Meta knows the harm its products cause young users. Instead of protecting them, the company lied to teens, parents, and the public and doubled down on features that are fueling anxiety, depression, body dysmorphia, and compulsive use. As Attorney General, protecting our kids is

Just a matter of Meta's public relations efforts. One has to really be focused on the trial(s), similar to Cambridge Analytica, to not get spun by Stone. Agree they want the shock value number along with fire up Taylor Lorenz to broadcast yarns of injunction risks to poor Insta.

But I think Jason Slothouber of the Colorado AG's office is doing a good job of contrasting for this jury what @meta said publicly about the prevalence of harmful content (very low), and what it kept secret about internal surveys that showed, according to Bejar, a high incidence

From my experience on these landmark trials in DC/VA, Meta will likely host a daily call for trade press to review (aka spin) what happened in court. Anyone in courtroom sharing on X what actually happens, pls share their handle for my list. Thx. I know @mlexclusive is there.

There is nothing more important than the safety and wellbeing of our children. But we can't protect our kids if Big Tech fails to provide truthful information about its products. That's why we are in court today — to hold Meta accountable for the harm they've caused.

Today in California kicks off “the largest consumer protection lawsuit in American history” involving the same company with the largest settlements in history privacy violations, too. A thread and link to complaint since most coverage is avoiding the allegations and evidence.
