The US Department of Commerce's BIS is formally investigating whether Chinese companies like Moonshot are accessing advanced US AI chips to train their models

The investigation follows a public allegation that Moonshot accessed GB300-equipped servers in Thailand, bringing an asserted overseas-compute route under formal Commerce Department scrutiny: the reported Thailand server access.

It also extends a longer effort to close routes around chip restrictions, after Nvidia was reported to be adapting products for China-compliant sales and policymakers considered overseas-subsidiary loopholes.

  • Moonshot and other Chinese model developers face a formal review of whether their training compute involved restricted advanced US chips; the immediate issue is access and end use, not merely chip purchases.
  • The case increases scrutiny of cross-border server arrangements and corporate structures used by Chinese AI companies, including the overseas routes alleged in Moonshot’s case.

Second-order effects

    We support open-source AI and the innovation it unlocks. But open source is not open season on American IP. When PRC firms conduct covert, industrial-scale distillation attacks that cross the line into IP theft, sanctions and Entity List designations will be on the table.
