French prosecutors escalate an investigation into Elon Musk and X, focused on alleged algorithmic manipulation and sexual deepfakes, to a criminal probe

French cybercrime authorities have escalated an investigation of Elon Musk and his social network X to a criminal probe, the Paris prosecutor's office said Thursday.

CNBC Lora Kolodny

Context & Ripple Effects

The French case has progressed from a January 2025 complaint over allegedly biased algorithms to a Paris cyber-prosecutor probe, then to allegations involving foreign interference, data extraction, and sexual deepfakes. X has publicly argued that the criminal investigation misapplies French law.

The escalation follows reported raids on X’s French offices and summonses for Elon Musk and then-X CEO Linda Yaccarino. It also extends a longer French legal conflict with X that included AFP’s 2023 content-payment lawsuit.

First-order effects

  • X and Musk now face a criminal, rather than preliminary, investigative process in France over alleged algorithmic manipulation and sexual deepfakes, increasing legal and operational scrutiny of the platform’s systems and records.
  • French prosecutors gain a stronger procedural basis to examine how X’s recommendation, moderation, and related data practices were operated in the alleged conduct.

Second-order effects

  • X will have to balance its public legal challenge with cooperation and evidence-preservation demands, potentially making its algorithmic and content-governance practices a more central management issue in France.
  • The case raises the compliance stakes for other large platforms operating in France when algorithmic amplification and synthetic sexual content become subjects of criminal—not solely regulatory—scrutiny.

Third-order effects

  • If French prosecutors can sustain criminal theories around platform design and algorithmic influence, enforcement may shift toward treating certain recommender-system and deepfake failures as potential criminal-accountability questions for platforms and executives.
  • The broader structural pressure is toward greater legal scrutiny of how platforms operationalize ranking, data access, and harmful synthetic media, though the eventual reach of this approach depends on the outcome of the X case.

The trend: This is part of a shift from disputes over platform content rules toward direct legal scrutiny of the systems that distribute and generate harmful or deceptive material.

Despicable. I hope these French prosecutors are charged for their attack on free speech. Thank god for Elon Musk and X. [image]

they call him a criminal for allowing us to speak freely

CRIMINAL charges. Unlike civil charges, extradition can be ordered for criminal charges. Musk will have no choice in the matter, and any country refusing to extradite according to such agreements would be shown in a very poor light.
