AND THAT'S A WRAP! A very solid hearing for Anthropic. It's never wise to predict what a judge will do, but I will be very surprised if Judge Lin does not provide some interim relief for Anthropic. Whether that relief will be sufficient is the remaining question in my mind.

@deanwball And credit to Anthropic's lawyers, they pick up on it immediately. Even if the congressional notification requirement was not met, the Pentagon itself still needs its own reasoning to justify taking the measure versus others, which is not clear from the record.

@deanwball Judge Lin getting into the meat of the matter, does the restriction apply to only “national security systems” or all DoW contracting? DoW lawyer appears to point to latter. Hard to square that with the clear language of 3252 covering only “national security system[s]”

Anthropic's argument here hinges on a pretty common Trump-admin tactic: Announcing some giant bombastic change that's wildly illegal, then quietly rolling out a (somewhat) more defensible form in official channels. Anthropic is saying, well, the bombastic claim hurts us too.

Pete Hegseth tweeted, basically, “this is my ultra-super official determination, and it is absolutely final,” and the government's lawyers are standing in court with a straight face saying this “had no legal effect and no reasonable person should have concluded that it did.”
