Sources: the FTC is preparing an antitrust lawsuit against Amazon, though the timing remains in flux, and is also scrutinizing Amazon Prime's bundling practices

Wall Street Journal

Context & Ripple Effects

The reported case was part of a broader FTC pursuit that also encompassed a possible challenge to Amazon’s iRobot acquisition and a dark-pattern investigation, as outlined in the agency’s wider Amazon agenda. Subsequent coverage shows the agency narrowing that effort toward Amazon’s core marketplace and moving toward a federal filing.

First-order effects

  • Amazon faces simultaneous scrutiny of its marketplace conduct and the way Prime bundles benefits, requiring it to defend practices that connect its retail platform and membership program.
  • The FTC’s preparation of a lawsuit puts Amazon’s Prime design and marketplace operations under a single, more consequential enforcement process.

Second-order effects

  • Amazon’s lack of concessions in a later FTC meeting set up the agency’s planned September filing, indicating that voluntary changes were not resolving the dispute.
  • A federal case centered on the marketplace would force Amazon’s third-party sellers and retail partners to track whether any challenged platform practices change during litigation.

Third-order effects

  • The progression from a broad investigation to a planned federal marketplace case points to antitrust enforcement examining how large platforms join consumer memberships with the rules governing commercial participants.
  • If the FTC’s case tests Prime bundling alongside marketplace conduct, future platform cases may increasingly treat linked consumer and merchant-facing services as one competitive system.

The trend: US platform antitrust enforcement is moving from wide-ranging investigations toward cases that test how marketplace operators use interconnected services and membership programs.

The antitrust battles are escalating. The FTC has already sued Facebook for “buying and freezing out small startups to choke competition.” The case is pending. The DOJ also filed two broad antitrust suits against Google, incl one last month over ad-tech. https://www.wsj.com/...

What might they focus on? ❓Self preferencing? It serves customers, isn't illegal, and AICOA failed. ❓ Buy box policies? @AGKarlRacine's case flopped, and @AGRobBonta already has a case pending? ❓Store brands? Also not a problem...unless Costco's Kirkland is now too https://twitte…

It's been 6 years since “Amazon's Antitrust Paradox” by Lina Khan. It would be a seminal case to have the antitrust suit against Amazon go through the courts, irregardless what the final decision is.

A suit would be a signature moment in the tenure of FTC Chair Lina Khan, who built her career by arguing in a widely read academic paper that Amazon had amassed too much market power and that antitrust law had failed to restrain it $AMZN

Scoop: The FTC is preparing a potential antitrust lawsuit against Amazon that could challenge an array of Amazon's business practices as anticompetitive. Suit could land as soon as the spring. w/ @brkend https://www.wsj.com/... $AMZN
