A US judge revokes SBF's bail after the DOJ accused him of tampering with witnesses, such as by sharing former Alameda CEO Caroline Ellison's diary with the NYT

Reuters Luc Cohen

Context & Ripple Effects

The detention follows prosecutors’ July request to jail Bankman-Fried over alleged witness interference and an earlier effort by the court to tighten how his communications were preserved while he was on release. The dispute had therefore moved from setting bail conditions to enforcing them.

Caroline Ellison was already central to the case narrative: prior coverage described the government’s contention that Bankman-Fried remained involved with Alameda despite his public account of stepping back.

First-order effects

  • Bankman-Fried loses pretrial release and faces a far more constrained ability to communicate outside his legal team as the case proceeds.
  • The DOJ’s witness-tampering allegation receives immediate judicial force, while Ellison’s personal writings become a more consequential focal point in the prosecution-defense conflict.

Second-order effects

  • Defense preparation becomes more operationally difficult, since attorney access, document review, and any permitted communications must work within detention rules rather than the prior bail arrangement.
  • The ruling reinforces the court’s earlier concern over preserving Bankman-Fried’s electronic communications, increasing the importance of clear, auditable boundaries around contact with witnesses and the press.

Third-order effects

  • If courts treat alleged public dissemination of witness-related material as grounds to revoke release, high-profile white-collar defendants may face stricter pretrial communication limits even before guilt is decided.
  • The case illustrates how digital messages and media disclosures can turn bail supervision into a substantive front in complex financial-crime prosecutions, not merely an administrative condition.

The trend: Complex financial-crime cases are putting greater weight on defendants’ digital communications and witness-contact rules during the pretrial period.

OK - now US v. Bankman-Fried hearing on possible remand of SBF to jail for intimidating witnesses, including leaking Caroline Ellison's Google Docs (still sealed) to the NYT. Inner City Press moved to unseal https://storage.courtlistener.com/ ... & will live tweet, thread below […

Bahahahahahaah Take that, you witness tampering vegan-faking, money stealing, egotistical, delusional, coked-up, fraudulent, orgy-goblin, bean bag sleeping, self-entitled, stuck-up, pudgy little, twatwaffle. I hope you enjoy prison. 🫡

Judge Kaplan: The defendant is remanded. AUSA Sassoon: This should not change the trial date. We'll stick to all deadlines. [US Marshals move in - SBF takes off his jacket and tie, leans down to take off his shoelaces

Judge Kaplan: He subscribed from the Bahamas and used a VPN as if he were in the Bahamas when he was in Palo Alto and could have watched it on public TV. It shows the mindset. All things considered I am going to revoke bail.

I was in the courtroom when Sam Bankman-Fried was just ordered to jail. The reaction was downright funereal. Approached by three U.S. Marshalls, Sam took off his jacket, tie, shoes and emptied his pockets. His mom broke down in tears. Press were escorted out before the cuffs.

“SBF takes off his jacket and tie, leans down to take off his shoelaces” Yikes. Hard to picture Sam Bankman-Fried in Rikers, but assume that's where he's spending the night https://fortune.com/...

SBF appeal of remand to jail filed less than an hour after handcuffs, $505 filing fee paid - Inner City Press will follow the appeal in the Second Circuit, too [image]

NEW — I just left a dramatic, emotional courtroom hearing at US District Court in Manhattan. Sam Bankman-Fried has been ordered to jail.

SBF was free on $250 million bail, but using a VPN to watch a football game and contacting a witness over Signal has put the former crypto billionaire in prison as he awaits trial. https://www.theverge.com/...

Judge Kaplan: The defendant had the reporter come to his home and didn't give him copies but rather see it and take notes. There are quotes in the NYT identical to the language in those documents [which are still sealed despite this: https://storage.courtlistener.com/ ...
  • @innercitypress @innercitypress on x
Judge Kaplan: Mr. Bankman-Fried entertained the reporter at his parents' home in Palo Alto and showed some portion of Ms. Ellison's private writings. The US said it was to intimidate her and others. The defense says it's about a First Amendment right
  • @innercitypress @innercitypress on x
Judge Kaplan: In view of the evidence, my conclusion is that there is probable cause to believe that the defendant has attempted to tamper with witnesses at least twice under Section 1512(b)

SBF is really running out of ways to dig himself into more trouble, but I'm sure a boy genius such as himself will find a way, even from jail. Tapping out messages to other inmates on the pipes? Scratching detailed “explanations” into the wall?
