Sources: US DOJ officials are weighing fraud charges against Binance but worry that an indictment could cause a run on the exchange like the one that befell FTX

U.S. Department of Justice officials are considering fraud charges against crypto exchange Binance, but are concerned about the cost …

Semafor Reed Albergotti

Context & Ripple Effects

The report extends a multiyear U.S. scrutiny arc: Binance had already faced a DOJ and IRS investigation and a broader inquiry that added alleged market-manipulation concerns. Prosecutors were also previously reported to be divided over charges and a possible plea framework in earlier charging deliberations.

By April 2023, coverage described mounting pressure, including the DOJ money-laundering division’s role in the case. The new element is that officials are reportedly weighing not only the merits of fraud charges, but also the market-stability consequences of bringing them against a major exchange.

First-order effects

  • Binance faces an immediate confidence-management problem: reported criminal-charge deliberations can affect how customers, counterparties, and employees assess the exchange even before any formal action.
  • The DOJ’s decision becomes a sequencing and enforcement-design question, with officials reportedly balancing a fraud case against the risk that an indictment itself destabilizes the platform.

Second-order effects

  • The FTX comparison raises the stakes for Binance’s counterparties and customers, which may place greater weight on access to assets and operational continuity rather than legal outcomes alone.
  • Other large crypto platforms may face pressure to show that they can withstand sudden confidence shocks, especially as U.S. investigations increasingly span money laundering, sanctions, and market-conduct allegations.

Third-order effects

  • If this pattern persists, crypto enforcement will increasingly have to account for the concentration of customer assets and activity at major intermediaries, not solely the alleged conduct under investigation.
  • The episode fits a longer shift in which exchanges seeking mainstream financial legitimacy are judged both on compliance exposure and on whether their structure can contain a loss of trust.

The trend: This is one data point in the widening crypto legitimacy gap, where enforcement risk and platform-run risk become intertwined for large exchanges.

We don't want to charge them with crimes because it will cause people to lose faith in their business is a weird set of priorities for the Department of Justice to have.

Binance is approximately the 100th largest financial institution in world by revenue, and as the State(s) wakes up to that, I'd expect not deference but rather a few steps taken to risk mitigate prior to final disposition. Tourniquet, amputate, cauterize, in that order.

The fact that some people think the DoJ is just going to drop their fight against CZ and isn't bringing criminal charges is insane. Even if 99% of things published were untrue, the remaining 1% of stuff he “4's” would still merit charges. This battle will happen...

How interesting. Wouldn't have to be worried about a run on an exchange...if it were... you know... solvent. [image]

The DoJ who slaps mega corps upside the head without remorse, who seizes companies and domains overnight, and fucks over consumers all the time, is worried about the scale of damage Binance will cause with a balance sheet hole in a bank run.... That's helpful scale.

The idea a crypto exchange is too big to fail seems as nuts as keeping your assets on Binance.

Rumor has it CZ will launch a new stablecoin for every FUD headline and formal charge thrown at Binance. [image]

The DoJ is actively considering fraud charges against Binance and directly against CZ. The only thing that gives them pause is the risk of a run. That means there is a gap in funds. How big a gap? So the DoJ is saying they believe the economic risk here is FUCKING massive.

Scoop: Why haven't criminal charges been brought against Binance? The debate within the DOJ is whether it would cause a run on the bank and hurt consumers. https://www.semafor.com/...

do the feds realize that if binance isnt doing fraud then it doesnt matter if there's a run since all the money should be there?

The sources for this story sound a lot like the sources who floated that Binance might pay a $2B fine to the U.S. government to basically make everything go away earlier this year. https://www.semafor.com/...

Pretty clear that they will charge as they are already pursuing a path to safeguard US citizens value at Binance US and then take the next step. Matter of time. Also SEC may step in at the same time.
