I agree with you.  I also think that the public utility model is not workable for digital services.  It's an interesting situation to observe because privacy authorities are (still) quite apprehensive about the consequences of this approach and seem not to want to be perceived as overstepping (which they are doing).

Preliminary findings: the EU says Meta's pay or consent ad model breaches the DMA; Meta faces a fine of up to 10% of its global annual turnover if found guilty

In a new substack on “pay or OK,” I sketch out the options being discussed by EU officials and academics on how to assess what is an “appropriate fee” (e.g. to be charged for the “no ads” tier by Facebook).  I discuss cost-plus, foregone revenue, willigness to pay, capacity to pay, and price benchmarking. https://barczentewicz.substack.com/ ...

Bloomberg reports that Meta is “set to be hit by a Europe-wide ban” on personalised advertising. I respond with an emergency newsletter to help explain how this “ban” is unlikely to actually be a ban. [image]

7/ Key question is whether ‘bulk data collection’ by US intelligence authorities can be squared with ‘adequacy’ with EU law. The EU Commission says ‘yes,’ relying on a distinction between domestic and international surveillance and on it being limited, not ‘mass surveillance.’

The EU and the US agree to a new data transfer deal, which is likely to face a legal challenge given EU judges threw out two prior pacts over privacy concerns

I see a lot of breathless misleading reporting about CJEU's Meta judgment based on the press release. Especially this sentence, where the nuance is that it refers to off-platform data ("data at issue"). The question of first-party data is not that clear [image]
