Quantum of damage still to be decided, and of course Apple will appeal, but let's not pretend that we need to give regulators awesome new discretionary powers to tackle this kind of conduct.

If European antitrust authorities have the power wielded in this decision, there was no need for the DMA.

I wonder who is leaking this? Competitors trying to get reporters to start sniffing around and giving the DMA team grief for focusing elsewhere? Or the EC trying to flex its muscles and make Amazon dance? https://www.reuters.com/...

Yesterday the EU Commission's Consumer Protection Cooperation Network announced new enforcement actions against Meta for its “Pay or OK” binary service option. This is the third-case against Meta for the same conduct. What the EU needs is to simplify and streamline enforcement.

The EU tells Meta its “pay or consent” model for Facebook and Instagram may violate consumer protection laws, giving Meta until September 1 to propose changes

Instead of having separate investigations from authorities issuing conflicting rulings covering the same conduct, the EU could harmonise rules for large, systemically important platforms that offer the market digital services, a simple and clear list of Do's and Don'ts.

Commission successfully closes its investigation into Apple's (formerly) closed NFC payment technology, now open to rivals. DMA box is also ticked. We should see some changes on the market very soon. A few thoughts in this thread. https://x.com/...

Apple settles with the EU over Apple Pay and avoids potential fines by agreeing to open NFC access on iOS to third-party wallet developers for free for a decade

What's underreported about today's settlement is that it does not give access to Apple's “Secure Element” technology, it's payment card emulation, using (presumably) standard NFC technology. This probably played into the Commission's hand, i.e. NFC isn't proprietary to Apple [image]

Apple settles with the EU over Apple Pay and avoids potential fines by agreeing to open NFC access on iOS to third-party wallet developers for free for a decade

What will be really interesting is whether there will be a way to track the extent of fraud committed against users who choose these third-party wallets and this HCE alternative, instead of the proprietary Apple tech. Maybe the difference will be significant, maybe marginal.

It's pretty obvious actually. In the press release, Vestager is quoted as saying “The developers' community and consumers are eager to offer alternatives to the App Store. We will investigate to ensure Apple does not undermine these efforts.”

One additional point of interest: the press release states that the “none of Apple's three sets of business terms would comply with Article 5(4) of the DMA”, so it's not just one systematic infringement, but potentially three separate infringements. That could have implications
