My impressions on the TikTok oral argument in the DC Circuit today (constitutionality of the ban bill): 1/ Nobody talked about bills of attainder or takings. The juice here is in the 1A. 2/ It wasn't a blowout, but on the whole, rough day for ByteDance/TikTok.

My impressions on the TikTok oral argument in the DC Circuit today (constitutionality of the ban bill): 1/ Nobody talked about bills of attainder or takings.  The juice here is in the 1A.  2/ It wasn't a blowout, but on the whole, rough day for ByteDance/TikTok.

8/ Overall, not a good day for TT/BD (despite a meh performance from DOJ's counsel).  The judges seemed likely to find that this case does have some important speech implications (maybe intermediate scrutiny?) but seemed averse to strict scrutiny.  But it could still go either way.

9/ Oh.  And: This thing is gonna get appealed by whoever loses.  They might appeal en banc to the DC Circuit (if they want to slow things down) but after that or without that, somebody will appeal to SCOTUS.  Whether SCOTUS grants cert, we don't know.  But a cert petition is a given.
